Terms of Service

1. Acceptance of terms
By accessing or using Driftly ("the Service"), operated at getdriftly.dev, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. Driftly is operated by Tecnov8 Ltd, a technology company registered in England and Wales.
2. Beta service disclaimer
Driftly is currently in beta. The Service is provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the reliability, availability, accuracy, or completeness of the Service. Features may change, break, or be removed without notice.
You acknowledge that the Service is under active development and may contain bugs, errors, or interruptions. Use of the Service during the beta period is at your own risk.
3. No guarantee of monitoring
Driftly provides API monitoring as a best-effort service. We do not guarantee that all checks will execute on time, that all alerts will be delivered, or that the Service will detect every API change, outage, or schema violation. You should not rely on Driftly as your sole monitoring solution for critical or production systems.
4. Your account
You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating an account. You may not use the Service for any unlawful purpose or to monitor endpoints you do not have permission to access.
5. Acceptable use
You agree not to:
- Use the Service to overload, attack, or disrupt third-party APIs or services.
- Monitor endpoints without authorisation from the endpoint owner.
- Attempt to circumvent plan limits, rate limits, or security measures.
- Resell, sublicense, or redistribute the Service without permission.
- Use the Service to store or transmit malicious content.
We reserve the right to suspend or terminate accounts that violate these terms.
6. Billing and subscriptions
Paid plans are billed monthly via Stripe. You can upgrade, downgrade, or cancel your subscription at any time through the billing portal. Cancellations take effect at the end of the current billing period. We do not offer refunds for partial months.
We reserve the right to change pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
7. Limitation of liability
To the maximum extent permitted by law, Driftly and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or business opportunities.
- Loss of data or damage caused by reliance on the Service.
- Downtime, missed alerts, or undetected API changes.
- Any issues arising from third-party services (Stripe, email providers, etc.).
Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim, or £50, whichever is greater.
8. Disclaimer of warranties
The Service is provided "as is" without warranty of any kind. We disclaim all warranties, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
9. Data and privacy
Your use of the Service is also governed by our Privacy Policy. By using Driftly, you acknowledge that we process data as described in that policy.
10. Intellectual property
All content, code, and branding associated with Driftly are owned by us. You retain ownership of any data you submit to the Service. By using the Service, you grant us a limited licence to process your data solely for the purpose of providing the Service.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.
12. Changes to these terms
We may update these terms from time to time. We will notify you of material changes by email or through a notice on the website. Continued use of the Service after changes constitutes acceptance of the updated terms.
13. Governing law
These terms are governed by the laws of England and Wales. Any disputes arising from these terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
